>> all lanes now open in the north bay southbound 101 sir francis drake boulevard. no delays for your back to school tuesday. >> we welcome frances back on this back to work tuesday. thank you for joining us. i'm eric thomas. >> i'm kristen sze. back to school, the school year's just getting started and one bay area school district is talking closure. the fate of three richmond schools will be decided oddly enough by the city council. terry mcsweeney is live at kennedy high school which is on the chopping block. terry? >> yes. three schools, 900 students, dozens of faculty members will all be impacted by tonight's decision. the city council is being asked to provide $1.5 million to keep kennedy high, grant and the elementary school open. the school district like so many others have been hit hard by state budget cuts, turning to the city for money now, also

declining enrollment. the city of richmond does have money, money coming in from the next ten years from a utility tax settlement. >> i feel a small part of that money be allocated towards keeping schools open. >> i can count on one hand probably the number of high schools in the east bay that have closed in the last 50 or 60 years. it's not common. >> now, the very same three schools were on the chopping block one year ago. the city came through to save them at that time. part of the problem as i mentioned, declining enrollment. four other schools were closed last year. now, the city and the school district are feeling if there's a good way to do this, and that is provide the $1.5 million, buy some time, figure out a way to share a variety of facilities between the city and the school district. and one would be the swim center here at kennedy high school. that vote is tonight.

>> terry, thank you very much. in novato, 30 to 40 angry parents are being forced to move their kids to another school because of overbooing at the school they currently attend. the students started the year at olive elementary ten days ago but school officials decided to transfer approximately three dozen students to maintain class sizes at olive at 20 students per teacher in grades k-3. that apparently is the ratio that gets the most state money. some parents are appealing the decision. >> 6:03. in the east bay a police chase ended with the arrest of an armed parolee in west oakland. the suspect drove his car into the grassy median at mandela parkway and 28th street before 1:00 this morning. officers tried to stop the man for speeding but he tried to outrun them before his car became disabled. >> check revealed he was on parole and currently out on bail for another offense. >> he can go back to prison? >> he is under arrest at this

point. officers have also recovered a firearm. >> paramedics examined the suspect for any injuries he might have suffered during the chase. officers then took him to alameda's north county jail for booking. meanwhile the chp says one man is in custody and another is still on the run this morning after a police chase and crash in hayward yesterday. check it out. started when a chp officer tried to pull over the driver of this s.u.v. for talking on a cellphone. instead of stopping he took off cross the boulevard, crashed and eventually flipped over. the driver and passenger ran away. the officer caught up with the driver and found a gun in the car but never found a passenger. a woman and child were in one of those cars hit by the reckless driver. they were taken to the hospital but are expected to be okay. >> it's 6:04. for a fifth straight day, hercules police and volunteers will be digging for clues linked to a missing man at a pittsburgh

landfill. researchers remain focussed on a one acre stretch of the keller canyon landfill hoping to find something that leads to frederick sales' whereabouts. he could be the fifth victim in the string of east bay murder by valdemoro. he was killed following a high-speed chase last week. so far the tedious search has yielded just one clue and it's not much. >> the only thing they have found is a piece of letterhead that had a hercules address on it, but it's not related to this case. >> the letterhead does confirm investigators are searching in the right area where trash from hercules was dumped. possibly the same trash collected from the business park where valdemoro once worked and where the car he drove was discovered abandoned last week. >> this morning we're learning a man killed outside a hotel in newark over the weekend had been suspected of murder two years ago. the body of resident julius hughes was found in a parking

lot next to the hotel. investigators say hughes was among several hundred people who couldn't get into a private party sunday night inside the hotel celebrating the start of the nfl season. when police arrived to break up the overflow party, they reported hearing several shots fired but didn't find any victim. hughes was previously accused of gunning down a man during a robbery outside a san francisco cannibis club in 2008 but a grand jury refused to indict him. >> less than 45 minutes from now the coast guard will return to the bay to try to solve a may day mystery. before 10:00 last night they got a radio call with a cryptic female voice saying listen, i have a may day. they managed to trace the call near the coast of tiburon and searched the area but found nothing. there were no reports of missing boaters and no recreational boats in the area. at dawn rescuers will return to the area with more boats and helicopters in hopes of finding something. >> a new survey found noise levels on bart trains can be

harmful to your hearing reaching 100 decibels, the equivalent to a jack hammer. the san francisco chronicle surveyed the entire bart system. officials say much of the noise on bart is caused by steel wheel trains repeatedly rolling over steel rails. a bart spokesman said the agency had a top rating among comparable rail systems nationwide. the worst lines are west oakland to embarcadero stations to mission street. the quietest route, hayward to south hayward station. >> it is 6:07. time to check the forecast. that cooldown mike's been promising us is here. >> and it didn't come gradually. >> this afternoon you'll notice how much different it's going to be. but right now temperatures are running pretty close to where they have been the last couple mornings if not a little warmer. santa rosa, novato 50.

outrage by a guatemala man shot and killed by chp officers sunday. >> that was a bottle breaking when the protest escalated and people started throwing bottles and plastic crates at police last night. the demonstration began yesterday afternoon when they marched between the location of sunday's shooting and a police station. police say they were forced to shoot the gattuso immigrant on sunday after he lunged at them with a knife. >> there are new accusations that chevron oil may be trying to cut a deal with sacramento lawmakers to get around state environmental laws. chevron has been trying to rebuild and upgrade its richmond refinery. environmental and community groups filed suit arguing the company was concealing plans to process heavier grades of crude which can increase pollution. a judge agreed and halted work last year. the san jose mercury news reports that chevron's lobbyists have been trying to craft a deal to give the company an exemption

from state law that requires environmental studies of major projects. >> time for must reads. let's start with the health epidemic here in california, the whopping cough. state analysis shows diagnoses of eight deaths. all were babies, all taken to a clinic or hospital several times before doctors made an accurate diagnosis. the upshot is had doctors figured it out sooner the infants might have lived. so far 3600 cases have been reported this year in california with the worst possibly still to come now that school has started. >> "the new york times" looks at why the tech sector is slow to hire despite once being a dynamo. government figure show employment in data processing and software publishing has fallen in the past year and computer scientists, system analysts and computer programmers have jobless rates in the second quarter 6%. >> our media partner reports

south san francisco, sausalito, partly sunny. maybe pockets of sunshine and low to mid-60s. from san rafael northward, mid to upper 70s with about 20 degrees cooler with upper 50s at your beaches. along the east bay shore, breezy from richmond to san leandro, that's why you're upper 60s. big drop east bay valleys. especially san ramon, upper 70s for you. highway 4 from concord to brendwood, low to mid-80s. gilroy 76, morgan hill 78. cloudy and fog around the monterey bay and mid to upper 60s. clouds get deeper into the east bay and even into the central valley. an idea how strong that sea breeze is going to be tonight. even drizzle along the coast with temperatures low to mid-50s. a look what is happening up there as cold air gathers as these longer nights develop up in canada and alaska. that cold air dropping down on the jet stream. in fact, here's a look at the cold front. today turns our winds onshore.

we actually tap into the colder air tonight and into tomorrow as the cold front moves through. you can see the drizzle along the coast through the early parts of wednesday and then a cool breeze that will drop us nearly 20 to almost 30 degrees in some spots from yesterday through tomorrow. in fact, by tomorrow we're only in the low to mid-70s inland with mid to upper 60s around the bay and mid-50s at the coast. watch for more clouds tomorrow and again drizzle in the morning. we'll see more sunshine starting thursday and especially friday through the weekend. temperatures will hit 60 along the coast, low 70s around the bay and low 80s inland. have great day. here's frances with an update. >> hope you enjoyed yesterday's day off because things are getting more crowded on the the freeways as a lot of folks head back to work. that's southbound 680 in walnut creek heading towards the valley and fine as you connect on westbound 24 and the bay bridge toll plaza, still fairly delay-free except for some of the cash paying lanes backed up

turning to the city council to see if it wants to come through to help out with the school district's problem. and what they're asking the school, the city council to do is come up with $1.5 million to come up for the school district. the only hope is have the city council come through with the money. >> if the city of richmond does not approve $1.5 million, then the board will take immediate action to close the school and send kids off to other schools like richmond high or el cerrito high. >> the city of richmond does have the money. it reached a settlement with chevron for $114 million in unpaid utility taxes and the city did come through last year to keep these schools open. if it does not approve the money, 900 students would be affected, including those at grand andlinda elementary. the city is recommending the money be approved. it will give the school district time to figure out how to work

close liz with the city. maybe some sharing of the facilities would help save money in the long-term so they don't have to come down to this crisis mode every school year. the vote is tonight. terry mcsweeney. >> thanks a lot. suspecteded gang member andrew barrientos will be in court this afternoon to face charges in the shooting of a fremont police officer. officer todd young has undergone several surgeries since being shot in east oakland august 25th while trying to serve a search warrant. he remains sedated in intensive care. the doctors expect him to make a full recovery. the santa rosa police officers association will hold a blood drive in officer young's honor today at the blood bank of the redwoods, local red cross blood banks report a 50% increase in donations since the call went out to donors. >> drinks may soon cost a little more in san francisco. the board of supervisors is

expected to vote whether to impose a new fee on liquor and wine wholesalers and distributors. the fee would be passed on to consumers. it would generate $16 million a year. the money would help the city pay for problems caused by alcohol abuse including unpaid ambulance bills and emergency room visits. >> a group of transit applicants will give $102 in cash to random passengers, part of the protest between bart's plan to link column assume station to the oakland airported with light rail system. transform says each trip on the line will cost taxpayers $102 the first 35 years connectors are in operation. bart expects the system to cost nearly $500 million. >> environmentalists are monitoring the petaluma river following an oil spill estimated in the hundreds of gallons. the department of fish and game

says an old tugboat was being chopped up for scrap metal when it leaked up to 600 gallons of oil yesterday. four booms were placed in front of creeks to keep the oil from seeping into the downtown area. no dead wildlife has been found so far and most of the oil slick has broken up and washed away. but environmentalists say the tides would likely continue to slosh the oil around the estuary. >> it comes in and out like a washing machine twice a day and will stick around until the sun and the air break it down. >> game officials are looking into the salvage operation to find out how long it was going on before the oil began to leak. >> 6:34. this morning a wildfire is threatening to swallow up entire neighborhoods west of boulder, colorado. it's burned five square miles taz number of structures have been destroyed and 1,000 homes have been evacuated. one couple lost their home and barely escaped the flames.

>> the house on top of the ridge. took out the house next to us and ours was third to go. >> flames are already coming up and over. >> the wind has been the biggest problem. at one point it picked up so bad that firefighters were pulled off the lines. the wind is also keeping air tankers grounded. >> 6:35 now. a look at our forecast. a little breezier today, mike? >> yes. cool breeze coming from the ocean transporting that cooler air over that 50 degree water into our neighborhood. kind of unofficially put summer to rest yesterday. we could still have warm days the next two months but definitely going to feel like fall today and even more so tomorrow. concord and santa rosa, 15 degrees. san jose 18. 19 degrees in oakland and 20 in redwood city and san francisco, 22 degrees cooler today than yesterday afternoon with that high of 62. 8:00 this morning seeing the clouds gather along the coast and into the bay. temperatures will hold steady in the upper 50s to near 60.

by noon we'll still have a few clouds around but most of it will be at the coast and into san francisco with upper 50s there to low 60s in oakland. upper 60s to low 70s for the rest of the bay. mid-70ss south bay and north bay and mid to upper 70s the east bay valleys. sunshine, mid to upper 70s in the east bay valleys with mid-70s in the south bay and north bay and mid to upper 60s around the bay except along the coast and downtown san francisco where the clouds keep you in the upper 50s to near 60 degrees. temperatures cooler tomorrow after morning drizzle. we'll have another 5 to 10 degree drop. slightly warmer as we head into next week. frances, haven't seen the bay bridge this busy in a long time. >> back to work, back to school. metering lights turned on a few minutes ago. fas trak lanes backed up to west grand. interstate 80 in berkeley, a new crash westbound i but it's on the shoulder. you notice it's crowded near university so the drive time has grown 23 minutes from the

put his face on billboards to embarrass phillips. >> jane king joins us live from the new york stock exchange with our "moneyscope" report. good morning, jane. >> hi, good morning, eric and kristen. no rest for the world markets with concerns overseas yet again heading home after we were off for labor day. many fear if greece would default it would trigger a collapse of banks. the world's biggest bond fund says greece still faces substantial risk of default. that's leading the banks lower on the concern they may not be able to handle a greece default. bank of america and citigroup, they are among those that are lower here this morning. here's a look where stocks are trading here today. we've got the dow, s & p, nasdaq all down. not dramatically so but the silicon valley index actually is trading a little bit positive, up by half a percent there. google's mission statement may be do no evil but the justice department trying to determine

whether google will gain too much tore with the travel industry if it requires software. the software powers the most popular travel website. concern that google can steer searches to its own travel services. consumerer reports just coming out with their tastiest burger ranking in fast food restaurants. the one that comes out on top, probably know who it is, consumer ranking 18 fast food restaurants, in and out burger, yes, i've been there and it is delicious. the survey, 28,000 subscribers of "consumer reports." mcdonald's at the bottom of the list. saying mcdonald's' least delicious burger that they've ever eating. live at the new york stock exchange, i'm jane king, bloomberg news. >> jane, you're an in and out burger girl. >> i am. i wish they had them here. i think an april fools story said in and out burger was coming to manhattan and everyone was excited. it turned out just to be a joke.

if you're interested, come on out! >> jane, thank you very much. >> marin county man who scaled the 60 story millennium towers in downtown san francisco is due in court. they cited dan goodwin after he scaled the skyscraper yesterday. he said it was for a reason. he believes skyscrapers are vulnerable for another terrorist attack. he says he climbed to also draw attention to the fight against cancer. goodwin is a survivor of stage 4 cancer. it almost killed him ten years ago. that's when he began planning this climb. >> in doing so i felt like i was doing it for all the cancer survivors out there. believe me, being up there you have to be so focussed on your every single move. there's no room for any error. just gotta be totally clear. >> goodwin now says he wants to go on a worldwide tour to climb legally to raise money to find a

cure for cancer. >> goodwin one of a small group of urban climbers who scale skyscrapers. another a french climber who goes by the name of spiderman, this climb of a 492 foot tall apartment building in sidney, australia, got him arrested on monday. back in 1977, george climbed the south tower of the world trade center. the city fined him $1.10, each for the skyscrapers 110 stories. >> that's not going to deter people from climbing. >> not really. >> could be a little scary, couldn't it. >> especially breezy day. >> a cool day today, a day with a little more humidity. drizzle tomorrow morning and cooler weather for wednesday. yeah, you can see the fast rushing sea breeze and the clouds developing as we look from ballmer peak southward along the east bay hills from ballmer peak and the berkeley

hills. let's take a look at the temperatures. they haven't responded yet but they will have afternoon. most of us still the mid to upper 50s, even 60s around los gatos, concord, antioch and fairfield. the cool spot santa rosa at 50. monterey bay, already seeing the cloud cover and cooler weather with low to mid-50s. cool and breezy today and cloudy at the coast. now the clouds will spread over all our neighborhoods today. drizzle along the coast and higher elevations along the bay. the coolest weather wednesday and thursday and a fairly mild weekend with temperatures pretty close to average. maybe a touch below. here's a look at the surge of clouds and the sea breeze through 8:00 this morning. the sun comes up, start overturning the atmosphere and the breezes will send out those clouds inland but still keep them at the coast, 50s today, 70s in the south bay and north bay and a few 80s still hanging on in the east bay valleys. mid-90s here yesterday but 80 in

concord highway 4 to 84 in brentwood and the san ramon valley. temperatures only upper 70s. save money, no need for the air conditioner. richmond, oakland, hayward, san leandro, low 70s for the rest of the east bay shore. san jose at 75. may hit 77 saratoga, 78 los gatos. the breeze will keep millbrae and san mateo in the upper 60s on the peninsula with low to mid-70s as you head to the south. upper 50s, kind of a raw, brisk day along the coast. south san francisco and sausalito. we will see some sunshine but low to mid-60s, well below average. mid to upper 70s through the north bay valleys but only upper 50s at your beaches. mid to upper 60s monterey bay but notice the clouds stub burn here. morgan hill 78 degrees. coliseum, first pitch cloudy and cool, especially compared to yesterday. about 66 dropping to 60. your seven-day forecast, about

10 minutes from highway 37 down towards 580. at the bridge toll plaza, pretty decent backup towards the west grand avenue overcrossing for most lanes down to the metering lights. and most slow spots are in the east bay. let's start with southbound 880 down towards tennisson where accident on the shoulder, 34 mph. westbound 580 had a few problems this morning. the stretch 205 to 680, 35 minutes. westbound 4 pretty heavy through antioch. you'll notice it does pick up through pittsburg. look out for that. this drive time 24 minutes on westbound 4. mass transit a great way to go because the system reporting no delays. you can get the latest and personalized drive times by going to our website, abc7news.com. the bay area traffic link is under abc 7 extras. >> frances, thanks a lot. a new study is proving that money can't buy love but it can apparently by happiness.

economists at the center for health and well-being at princeton university found people's emotional well-being increases along with their annual income up to about $75,000. but after that the effect leveled off. so no happier day-to-day even if you make more than 75 k. the overall sense of success continued to rise as the earnings grew beyond 75,000. that's overall life contentment. the study is in today's edition of proceedings for the national academy of sciences. >> the fates of three richmond schools will be decided by the richmond city council. >> terry mcsweeney is live at kennedy high school. one of those that could close depending on the council's vote today. terry? >> three schools, 900 students, all those faculty members will be impacted by tonight's decision. it is in fact the city council being asked for $1.5 million to keep kennedy high, grant elementary schools open.

the school district like so many other around the bay area hit hard by state budget cuts. also hit by declining enrollment here. the good news is that richmond has the money. they've got more than $100 million coming in over the next ten years from chevron because of a utility tax settlement. these same schools were on the chopping block last year. the city came through at that time but four other schools were closed. it's possible these schools are going to be cut loose. however, city managers recommending that the city provide the money to keep the schools open until a long-term solution can be put in place so they don't have to keep doing this $1.5 million to keep these three schools open next year. terry mcsweeney, abc news. >> a new report published by the san francisco chronicle warns that riding bart trains could be very hazardous to your hearing. the paper says some stretches of track create a noise level as

loud as a jack hammer. bart says it knows the trains can be noisy, especially because of the steel wheels rolling over steel rails but also say this is is the quietest rail system in the country. >> final economic on weather and traffic. mr. nicco? >> start with the temperatures today. notice the clouds along the coast at 59 half moon bay. low to mid-60s around san francisco, richmond with upper 60s in oakland and san mateo. low to mid-70s from fremont, palo alto through san jose. we'll have mid to upper 70s for san rafael, napa, vallejo, santa rosa and you see the 80 degree temperatures around concord, livermore and antioch along with fairfield, clear lake and cloverdale. santa cruz at 68 and morgan hill at 78. i think i've covered everybody there so let's talk about what's going to happen tonight. clouds will be thicker and the drizzle will fall along the coast and some of our higher elevations around the bay, temperatures low to mid-50s. tomorrow the coolest day in your forecast as we drop another 5 to 10 degrees with temperatures inland in the low to mid-70s.
